CabMin Enhances Implementation of Declarative Principle in Permit System
The Cabinet of Ministers of Ukraine amended its Resolution # 685, dated May 17, 2006, “On Procedures for Notifying OSS Administrator on Conformity of Entrepreneurs’ Material and Technical Resources to the Regulatory Requirements” to broaden application of the declarative principle in permit system.
The declarative principle is a procedure whereby a business entity gains the right to take certain actions in respect of doing business without completing permit procedures by simply notifying the administrator or the appropriate permit-issuing agency that its material/technical facilities meet legal requirements. Until now the declarative principle was applied in the fire safety sphere only. The amendments will allow for application of this principle in labor protection sphere as well as establish standard forms of declaration and improve certain procedures for declaration submission.
